Pear Diamonds & Co. Returns, Refunds, and Deposits Policy

1. Scope
1.1 This policy applies to purchases made from Pear Diamonds & Co. Ltd., operating as Pear Diamonds & Co. (the Company, we, us, our).
1.2 This policy is subject to applicable law. Statutory rights that cannot be excluded remain unaffected.
2. Return Window
2.1 Return requests must be submitted within seven (7) calendar days of:
a) the confirmed delivery date (for shipped orders); or
b) the pickup date or purchase date, as applicable (for pickup and Point of Sale purchases).
2.2 Requests submitted after the return window may be refused.
3. Final Sale Items
3.1 Products designated as Final Sale are not eligible for return, exchange, or refund, except as required by applicable law.
3.2 Final Sale designation may be communicated on the product page, at checkout, on the invoice/receipt, or by inclusion in a designated Final Sale collection.
4. Eligibility Conditions for Returns
4.1 A return may be accepted only if all conditions below are met:
a) the Company receives the return request within the return window;
b) the Company provides written return instructions;
c) the item is returned in original condition (unworn, unused, unaltered, and free of damage);
d) all original packaging and included materials (if any) are returned; and
e) the item passes inspection upon receipt.
4.2 The Company may refuse a return or reduce a refund where inspection confirms wear, alteration, damage, missing components, or other non-compliance with this policy.
5. Custom and Made-to-Order Orders
5.1 Custom and made-to-order items are generally not eligible for return or refund due to their bespoke nature, except as required by applicable law or as expressly agreed by the Company in writing.
5.2 Production Deposit (Non-Refundable): Where applicable, a production deposit equal to fifty percent (50%) of the total price is required to begin manufacturing (the Production Deposit). The Production Deposit is non-refundable, including in the event of cancellation or change of mind, except as required by applicable law.

5.3 Any additional deposits, design fees, or service fees (if applicable) are governed by the applicable quote, invoice, or written agreement and may be non-refundable as stated therein.
6. Return Shipping Costs and Transit Risk
6.1 Online orders: customers are responsible for arranging and paying for return shipping.
6.2 Customers bear the risk of loss or damage in transit until the returned item is received and inspected by the Company. Trackable, insured shipping with signature confirmation is recommended.
6.3 Point of Sale: return-shipping rules do not apply to returns completed through Point of Sale.
7. Restocking Fee
7.1 For eligible returns, a restocking fee of ten percent (10%) of the item price may be deducted from the refund (the Restocking Fee), unless prohibited by applicable law or waived by the Company in writing.
7.2 The Restocking Fee does not apply to returns processed through Point of Sale.
8. Refunds
8.1 If a return is approved, refunds are issued to the original payment method where feasible.
8.2 The refund amount is generally the item price paid, less the Restocking Fee (if applicable) and any lawful deductions.
8.3 Original shipping charges are not refundable unless required by applicable law or expressly agreed by the Company in writing.
8.4 Refunds are processed within a reasonable period after receipt and inspection. Payment processor timelines may vary.
9. Incorrect, Defective, or Damaged-on-Arrival Items
9.1 If an item is incorrect, defective, or damaged on arrival, the customer must contact the Company promptly and provide requested information (including photos/video where applicable).
9.2 The Company will assess the issue and, where appropriate, may offer a remedy (which may include repair, replacement, or refund), subject to verification and applicable law.
10. Policy Changes and Application
10.1 This policy applies to purchases made after the effective date above (or after the date this policy is posted/updated, as applicable).
10.2 The Company may update this policy from time to time.
